Provider Terms

1. Scope & Relationship to Terms of Service

These Provider Terms ("Provider Terms") apply to any individual or business that registers on Zaraya as a service provider ("Provider"). They supplement and are incorporated into the Zaraya Terms of Service. In the event of a conflict between these Provider Terms and the Terms of Service, these Provider Terms control with respect to Provider-specific matters.

By registering as a Provider on Zaraya, you agree to be bound by these Provider Terms in addition to the general Terms of Service.

2. Independent Contractor Status

Providers are independent contractors, not employees, agents, joint venturers, or partners of Zaraya Platforms LLC. Zaraya does not control, direct, supervise, or set the terms of the services Providers offer. Providers are solely responsible for determining how, when, and where they perform services, the tools and materials they use, and the clients they accept.

Nothing in these Provider Terms or the Terms of Service creates an employment relationship, partnership, franchise, or agency between Zaraya and any Provider. Providers are responsible for their own taxes, insurance, and business expenses. Zaraya does not withhold taxes on behalf of Providers.

3. Professional Licensing & Compliance

Providers are solely responsible for obtaining and maintaining all licenses, permits, certifications, registrations, and insurance required by applicable federal, state, and local laws to perform the services they offer. This includes, but is not limited to, cosmetology licenses, esthetician licenses, nail technician licenses, barbering licenses, and any other professional credentials required in the Provider's jurisdiction.

Zaraya does not verify, validate, or represent that any Provider holds the required credentials. Providers who allow their licenses to lapse, or who perform services without required credentials, do so entirely at their own risk and liability.

Providers must also comply with all applicable health, safety, and sanitation regulations, including those set by state cosmetology boards, health departments, and any other regulatory bodies with jurisdiction over their services.

4. Service Responsibility

Providers are solely responsible for the quality, safety, and outcomes of all services they perform. Zaraya makes no representations about and bears no responsibility for the services offered or rendered by any Provider.

Providers must perform services with the level of skill and care consistent with industry standards and their professional obligations. Providers who receive reports of harm, injury, or dissatisfaction related to their services must address those matters directly with the affected client. Zaraya is not a mediator, insurer, or guarantor of service outcomes.

5. Client Consent

Providers are solely responsible for obtaining all required client consents before performing services. This includes:

  • Chemical services (relaxers, perms, color treatments, keratin treatments) — Providers must disclose risks and obtain written or verbal consent from clients before application.
  • Allergy and patch tests — Where recommended by product manufacturers or professional standards, Providers must conduct patch tests and document results before proceeding.
  • Skin and aesthetic services — Providers must disclose any risks, contraindications, or aftercare requirements, and obtain client acknowledgment.
  • Photography consent — If a Provider photographs a client for portfolio use, the Provider must obtain the client's explicit consent before uploading those images to Zaraya or any other platform. See the Content & Portfolio Policy for more detail.

Zaraya bears no responsibility for services performed without proper client consent. Providers indemnify Zaraya for any claims arising from failure to obtain required consent.

6. Accurate Business Information

Providers must ensure that all information on their Zaraya profile is accurate, complete, and current at all times. This includes:

  • Business name, address, and contact information
  • Services offered and their descriptions
  • Pricing for each service
  • Staff names, roles, and specialties
  • Availability and booking hours
  • Credentials or certifications (if displayed)

Providers must not misrepresent their credentials, experience, pricing, or the nature of the services they provide. Misleading information that results in client confusion or harm may result in immediate account suspension or termination.

7. Pricing & Payments

Zaraya does not process payments between clients and Providers. Providers set their own pricing and collect payment directly from clients. All payment terms, deposits, cancellation fees, and refund policies are the Provider's sole responsibility and must be clearly communicated to clients.

Providers may not charge clients fees that were not disclosed in advance. Zaraya has no liability for disputes arising from pricing, payment, or refund disagreements between Providers and clients.

Providers who include links to external booking or payment systems in their Zaraya profile are solely responsible for the terms and operations of those external systems. Zaraya is not a party to any transactions occurring outside the Zaraya platform.

8. Booking Commitments

When a Provider accepts a booking request through Zaraya, it constitutes a commitment to the client. Providers must:

  • Honor confirmed bookings to the best of their ability.
  • Notify clients promptly if a confirmed booking must be cancelled or rescheduled, with as much advance notice as possible.
  • Communicate any changes to service availability, pricing, or staff through their Zaraya profile.

Providers who repeatedly cancel confirmed bookings, fail to appear for confirmed appointments, or otherwise fail to honor commitments may have their accounts suspended or terminated at Zaraya's discretion.

9. Portfolio & Uploaded Content

Providers may upload portfolio images, before-and-after photos, and other content to their Zaraya profile to showcase their work. All uploaded content is subject to the Content & Portfolio Policy, which Providers must read and comply with.

In summary: Providers may only upload images they have the right to use, must have obtained consent from any identifiable clients depicted, and must not upload images from other stylists' or businesses' portfolios without explicit written permission.

10. Professional Conduct

Providers must conduct themselves professionally in all interactions with clients facilitated through Zaraya. This includes:

  • Treating all clients with respect, regardless of background, identity, or appearance.
  • Maintaining a safe and sanitary environment for service delivery.
  • Responding to booking requests and client messages in a timely manner.
  • Not soliciting clients to move transactions entirely off-platform in a way that circumvents Zaraya's terms or harms clients.

Reports of harassment, discrimination, fraud, or unsafe conduct by a Provider will be investigated and may result in immediate account termination.

11. Indemnification

Providers agree to indemnify, defend, and hold harmless Zaraya Platforms LLC and its members, managers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the services the Provider performs or fails to perform; (b) the Provider's User Content; (c) the Provider's violation of these Provider Terms or the Terms of Service; (d) the Provider's violation of any applicable law or regulation; or (e) the Provider's violation of any third party's rights, including client rights.

12. Termination

Zaraya may suspend or terminate a Provider's access to the platform at any time, with or without notice, for conduct that violates these Provider Terms, the Terms of Service, or is otherwise harmful to clients, other Providers, or Zaraya. Providers may also request account deletion at any time by contacting us.
