Terms of Service

By creating an account on Zaraya or by using any part of our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use Zaraya. These Terms constitute a legally binding agreement between you and Zaraya Platforms LLC, a Texas limited liability company ("Zaraya," "we," "us," or "our").

Clicking "Create Account" or checking the acceptance box at registration constitutes your electronic signature and acceptance of these Terms, which has the same legal effect as a handwritten signature.

Zaraya is an online marketplace and booking platform that connects customers seeking beauty and personal care services with independent service providers ("Providers"). Zaraya itself does not provide beauty or personal care services.

Providers are independent contractors, not employees, agents, or representatives of Zaraya. Zaraya does not control, supervise, or direct the services Providers offer. Zaraya makes no representations about the quality, safety, suitability, or legality of any services listed on the platform.

You must be at least 18 years of age to create an account and use Zaraya independently. If you are between 13 and 17 years of age, you may only use Zaraya with the express consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. Zaraya is not intended for children under 13.

By using Zaraya, you represent and warrant that you meet the eligibility requirements above and that all information you provide is accurate, current, and complete.

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorized use of your account. Zaraya is not liable for losses resulting from unauthorized account access due to your failure to safeguard your credentials. You may not create more than one account per person or transfer your account to another party.

Booking Request Disclaimer. Booking requests submitted through Zaraya are not paid reservations. A booking is a request only and is not confirmed until the Provider explicitly accepts it. Zaraya does not process payments, hold deposits, or guarantee service availability. All payments, deposits, cancellation fees, and refund policies are determined and handled directly between you and the Provider. Zaraya has no liability for disputes arising from payment or service terms agreed upon outside the platform.

Bookings. Submitting a booking request through Zaraya is a request, not a confirmed appointment. A booking is confirmed only when a Provider explicitly accepts it. Zaraya does not guarantee that any Provider will accept a booking request.

Cancellations. If you need to cancel or reschedule, please do so with reasonable advance notice as a courtesy to the Provider. Providers may set and enforce their own cancellation policies.

No-Shows. Repeatedly failing to appear for confirmed bookings may result in Providers declining future requests and may lead to account suspension at Zaraya's discretion.

Accuracy. You are responsible for providing accurate information about the services you request, including any relevant health conditions, allergies, or preferences that may affect the service.

Independent Contractor. Providers using Zaraya are independent contractors and are solely responsible for their services, pricing, scheduling, and compliance with all applicable laws, regulations, and professional licensing requirements in their jurisdiction. Zaraya does not employ, supervise, or control Providers.

Professional Licensing. Providers are solely responsible for obtaining and maintaining all licenses, permits, certifications, and registrations required by applicable federal, state, and local law to perform the services they offer. Zaraya does not verify Provider credentials and makes no representation that any Provider is licensed or qualified. Providers must comply with all applicable health and safety regulations.

Client Consent. Providers are solely responsible for obtaining any required client consent before performing services — including disclosures and patch tests for chemical treatments, allergy screenings, or any procedure that carries health or safety considerations. Zaraya bears no responsibility for services performed without proper client consent.

Accurate Business Information. Providers must keep their business name, service offerings, pricing, staff, and availability accurate and up to date at all times. Misleading or outdated information that results in client harm may result in account termination.

Portfolio Images. By uploading portfolio or inspiration images to their Zaraya profile, Providers represent and warrant that they hold the right to use and display those images, including any necessary consent from identifiable clients or subjects depicted. Providers must not upload images belonging to other stylists or businesses without explicit permission.

External Booking Links. Providers may include links to external booking systems or websites in their profile. Zaraya is not a party to — and bears no responsibility for — any transactions, payments, deposits, cancellations, refunds, or agreements made through external links or systems. Clients using external links do so at their own risk.

Payments and Fees. Zaraya does not process payments between clients and Providers. All payment terms, deposits, cancellation fees, and refund policies are set and enforced solely by the Provider. Zaraya has no liability for payment disputes between clients and Providers.

Professional Conduct. Providers must conduct themselves professionally at all times and comply with all applicable health, safety, and licensing standards.

Cancellations. Providers who repeatedly cancel confirmed bookings or fail to honor commitments may have their accounts suspended or terminated.

By uploading photos, style boards, notes, or any other content ("User Content") to Zaraya, you grant Zaraya a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute that content in connection with operating and promoting the platform.

You represent and warrant that you own or have the necessary rights to all User Content you upload, and that your User Content does not infringe any third party's intellectual property, privacy, or other rights.

Zaraya reserves the right to remove any User Content that, in our sole judgment, violates these Terms, applicable law, or community standards, without prior notice.

The Zaraya platform, including its name, logo, design, software, and original content, is owned by Zaraya Platforms LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from Zaraya's proprietary content without our express written consent.

You agree not to:

• Create false or misleading accounts or impersonate any person or entity
• Harass, threaten, or harm other users or Providers
• Use automated tools to scrape, crawl, or extract data from the platform
• Circumvent or attempt to circumvent any security or access controls
• Use Zaraya for any unlawful purpose or in violation of any applicable law
• Post or transmit spam, malware, or other harmful content
• Interfere with the proper functioning of the platform or its servers

Violations of these prohibitions may result in immediate account termination and may expose you to civil or criminal liability.

Zaraya uses third-party services to operate the platform, including Supabase for authentication and cloud infrastructure for file storage. Your use of Zaraya is also subject to the terms and privacy policies of these third-party providers, and Zaraya is not responsible for their acts or omissions.

Zaraya may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party sites and do not endorse them.

THE ZARAYA PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ZARAYA DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PROVIDER IS LICENSED, QUALIFIED, OR SUITABLE FOR YOUR NEEDS. YOUR USE OF THE PLATFORM AND ANY SERVICES ARRANGED THROUGH IT IS ENTIRELY AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZARAYA LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ZARAYA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL ZARAYA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE TOTAL AMOUNTS PAID BY YOU TO ZARAYA, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Zaraya Platforms LLC and its members, managers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.

Informal Resolution. Before filing a formal dispute, you agree to contact Zaraya at the address below and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the platform shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in Texas.

Class Action Waiver. YOU AND ZARAYA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exceptions. Either party may seek emergency or injunctive relief in a court of competent jurisdiction in Texas without first engaging in arbitration.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

Zaraya reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the platform and, where practicable, by sending notice to the email address associated with your account at least 30 days before the changes take effect.

Your continued use of the platform after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the platform and may request account deletion.

Zaraya may suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms, is harmful to other users, Providers, or Zaraya, or for any other reason at our sole discretion.

You may delete your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately. Sections that by their nature should survive termination—including Sections 7, 8, 11, 12, 13, 14, and 15—shall survive.
